USDA Releases Four Final Rules

In late July, USDA announced four final rules to implement the remaining provisions of the Healthy, Hunger-Free Kids Act of 2010. These regulations relate to the Community Eligibility Provision (CEP), Smart Snacks, Local School Wellness Policies and Administrative Reviews.

Eliminating Applications Through Community Eligibility

The Community Eligibility Provision (CEP) final rule allows schools with high poverty rates to provide free breakfast and lunch to all students. The free/reduced eligibility threshold remains at 40%.

Nutrition Standards for All Foods Sold in School (Smart Snacks)

The Smart Snacks final rule aligns the nutritional quality of snacks sold to children during the school day with school lunch and breakfast requirements.

Local School Wellness Policy Implementation

The Local School Wellness Policy final rule ensures that any food or beverage marketed on school grounds during the school day meets the Smart Snacks standards.

Administrative Reviews in the School Nutrition Programs

The Administrative Review final rule updates the process used by state agencies to monitor federally funded school meal programs. Most state agencies are already implementing this updated review process.

"The actions we are announcing today continue the Administration's unprecedented commitment to building a healthier next generation and institutionalize the positive changes schools across the country have already made," said Secretary Vilsack in a press statement.
